Privacy Architecture

Third-Party Exposure Can Waive Privilege

Attorney-client privilege can be waived by disclosing privileged material to third parties who are not covered by the privilege. When a law firm uses a server-based PDF tool to process a privileged document, that document is transmitted to and processed by the tool operator -- a third party outside the attorney-client relationship.

Whether this technically constitutes a privilege waiver depends on jurisdiction, the nature of the disclosure, and whether reasonable precautions were taken. But the risk is entirely avoidable. Processing the document locally eliminates third-party disclosure as a factual matter, removing the question from consideration entirely.

ModernPDF's architecture means privileged documents remain under the firm's exclusive control throughout processing. The browser handles the PDF operation, and the output stays on the attorney's device. No server receives the document, no third-party employee can access it, and no external system stores it at any point.

Common Questions

Frequently Asked Questions

Yes. Since documents never leave your device during processing, there is no third-party disclosure. The privileged content remains under the attorney's exclusive control throughout the entire operation -- from loading the file through processing to downloading the result.

Yes. Merge exhibit documents into a single filing package, compress large filings to meet court electronic submission size limits, and redact sealed information before public filing -- all processed locally. Use Page Numbers to add Bates-style numbering to exhibit compilations.

The AI identifies names, case numbers, physical addresses, Social Security numbers, financial account numbers, and other sensitive identifiers. Each detection is highlighted for attorney review before any redaction is applied. For legal production work, manual verification of every AI suggestion is strongly recommended to ensure accuracy.

Redact PDF permanently removes content from the PDF file structure. The underlying text and image data is deleted, not merely covered with a visual overlay. Redacted information cannot be recovered from the output file by any means. Always verify the output before distribution.

Yes. The tool runs as inspectable client-side JavaScript and WebAssembly code. Your IT team can monitor all network traffic during operation and confirm zero outbound document data. We publish a security whitepaper with full architecture documentation suitable for IT and information security review.
